The argument gets made in almost every case. Whether it goes anywhere depends on these.
Did it have anything to do with the collision
A licensing violation raised as comparative fault has to be connected to how the crash actually happened. Where a driver turned left across an oncoming motorcycle, or pulled out from a side street into its path, it is difficult to explain what an endorsement would have changed.
