The four rules that decide your car accident claim
Car accident claims work differently in New Jersey than in most other states. These are the rules that decide who pays your bills, whether you can sue, and how much time you have.
Who pays my medical bills? (No-fault & PIP)
New Jersey is a no-fault state. Your own Personal Injury Protection (PIP) coverage pays your medical bills after a crash, regardless of who caused it. Standard policies carry a minimum PIP limit of $15,000, though higher limits are available and worth having.
The verbal threshold: can you sue for pain and suffering?
Your policy sets you up with either the verbal threshold (limitation on lawsuit) or no limitation on lawsuit. Under the verbal threshold, you can only recover pain and suffering if your injury meets a specific legal category, such as a displaced fracture, permanent injury, or significant scarring.
The 2-year deadline to file
New Jersey gives you two years from the date of the crash to file a car accident lawsuit. Miss it, and you almost always lose the right to recover. Claims against a government entity can require a Notice of Tort Claim within just 90 days.
What if the other driver has no insurance?
Your own uninsured and underinsured motorist (UM/UIM) coverage steps in when the at-fault driver has no insurance or not enough to cover your losses. For policies issued or renewed on or after January 1, 2026, New Jersey requires minimum UM/UIM limits of $35,000 per person and $70,000 per accident.
