The Stop and Stay Stopped Law
Drivers must stop, and remain stopped, for a pedestrian in a marked crosswalk, and must yield to pedestrians in an unmarked crosswalk at an intersection.
The law can favor the pedestrian
When a collision happens in a marked or unmarked crosswalk at an intersection, New Jersey law creates a permissive inference that the driver failed to exercise due care.
Being outside a crosswalk doesn't bar your claim
If you were not in a crosswalk when you were struck, you may still recover. New Jersey allows recovery as long as you are not more than 50 percent at fault, though your compensation may be reduced by your share of it.
The 2-year deadline to file
Most pedestrian accident claims must be filed within two years of the crash. Claims against a public entity can require a Notice of Tort Claim within just 90 days.
