Riders film because they know how these claims go. What most have not thought through is what happens to the recording afterwards, legally and practically.

Video of the road is not a wiretap issue. New Jersey's Wiretapping and Electronic Surveillance Control Act governs the interception of communications, not images, so silent footage of traffic, junctions and other vehicles in public sits outside it entirely. Where a camera also records sound, New Jersey is a one party consent state: a participant in a conversation may record it without telling the others, provided the recording is not made for a criminal, tortious or other injurious purpose. The Act also only reaches communications where the speaker had a reasonable expectation that they were not being recorded, and the Appellate Division has held that open filming visible to everyone present did not engage it. Mounting is where car drivers run into trouble. New Jersey prohibits driving with non transparent material on the front windshield and side shields that obstructs the driver's view. A helmet or handlebar mounted camera on a motorcycle is not in that position at all, which is one of the few respects in which riders have an easier time than drivers. The part that matters most is unglamorous. These cameras loop, overwriting in segments, and a rider taken from the scene by ambulance is not in a position to stop that happening. How riders lose the footage they were counting on

Neither has anything to do with the law.

It overwrites itself

These devices record in loops, replacing the oldest segments as they run. A rider taken from the scene by ambulance leaves a camera that may still be powered, or a memory card that will be recording again the moment the machine is next started. Somebody has to retrieve the device or the card and stop it, and that is not a task the person in hospital can perform. Ask a passenger, a colleague, a family member or a responder at the scene. Then secure the original file rather than a copy, because the original carries the timestamps and metadata that establish it has not been altered.

Editing it destroys it

The instinct to trim a clip to the relevant few seconds, or to remove a portion that looks unhelpful, is understandable and ruinous. Admissibility turns on authenticity, meaning the footage is what it purports to be and has not been altered. A trimmed or exported clip invites exactly the challenge that a complete original does not, and removing material after a claim exists creates a separate problem about preservation. Hand over everything, unaltered, and let it be assessed.

Three rules about recording

Confirm the current position, and note that the audio question is separate from the video one.

One party consent for audio

New Jersey permits a participant in a conversation to record it without notifying the other parties, provided the recording is not made for the purpose of committing a criminal or tortious act. Recording without any consent is a third degree crime and carries civil liability.

Only protected communications are covered

The Act reaches oral communications where the speaker exhibited an expectation that they were not subject to interception, in circumstances justifying that expectation. The Appellate Division has held that open filming visible to those present did not engage the Act.

N.J.S.A. 39:3-74

Obstruction rules address windshields

New Jersey prohibits driving with a sign, poster, sticker or other non transparent material upon the front windshield, wings, deflectors, side shields or corners of the windshield that obstructs the driver's view. That provision addresses a position a motorcycle camera does not occupy.

What to do about the recording

The first two steps are urgent and neither is legal work.

Get somebody to retrieve the device

From the helmet or the machine, before it is towed or stored. If you are being taken to hospital, ask someone at the scene to do it.

Stop it recording

Remove the memory card or power the unit down. A camera that starts again overwrites the segment you needed.

Preserve the original file

Not a copy, not an export, not a clip sent by message. The original carries the timestamps and metadata that establish authenticity.

Do not edit anything

Hand over the whole recording. Trimming invites a challenge that a complete original does not, and it is discoverable either way.
