The rental company is usually out
.avif)
Before 2005 several states held vehicle owners automatically responsible for crashes caused by anyone driving with permission, which put rental fleets on the hook for every customer's mistake. Congress ended that.
The Graves Amendment provides that an owner of a motor vehicle that rents or leases it out shall not be liable under the law of any state, by reason of being the owner, for harm arising out of the use, operation or possession of the vehicle during the rental or lease period. Two conditions apply. The owner must be engaged in the trade or business of renting or leasing motor vehicles, and there must be no negligence or criminal wrongdoing on the part of the owner. That is a bar on vicarious liability specifically, meaning responsibility arising purely from ownership. It is not immunity. The second condition is the opening, and it covers the company's own conduct rather than the driver's. Courts have applied it cautiously given the clear congressional intent behind the provision, so it is not a route to be assumed. One limit worth knowing. The protection applies to businesses in the trade of renting or leasing. It does not apply where a private individual lends their car to somebody, which is governed by an entirely different framework. James Vasquez has handled New Jersey injury claims since 2004.
Totowa car accident claims we take on
Who owned the vehicle shapes who can be pursued.

Where Totowa collisions happen
A small borough carrying substantial retail and highway traffic.
Union Boulevard
Through traffic with turning movements into frontage and side streets, producing frequent moderate speed impacts.
Worth establishing: the driver's own insurance, because in a rental collision that is frequently the primary source rather than the company's.
The residential streets
Narrow roads with vehicles emerging between parked cars into moving traffic.
Worth establishing: sight distance measured at the location rather than accepting a driver's account of what could be seen.
Route 46
Heavy volume past large commercial developments, with constant entry and exit across lanes and frequent jughandle movements.
Worth establishing: who owned the vehicle. Rental and fleet vehicles are common on this corridor and ownership changes who can be pursued.
The Route 80 approaches
Traffic joining and leaving across short distances at speed, where injuries are the most severe in the borough.
Worth establishing: whether the driver's limits are adequate, because serious injuries here routinely exceed minimum coverage.
In each of these the crash report records the registered owner, which is the first indication of whether a rental or leasing company is involved.
Four things about claims against rental companies
The bar is broad and it is not absolute.
Ownership alone is not enough
A rental or leasing business cannot be held liable under state law merely because it owned the vehicle, where it is in that trade and committed no negligence or criminal wrongdoing.
The owner's own negligence
Failure to maintain a vehicle the owner had agreed to maintain, or similar active negligence, falls outside the protection because it is not vicarious.
Negligent entrustment
Renting to somebody plainly unfit to have the vehicle, for instance without a valid licence, is the company's own conduct rather than the driver's.
Only businesses in the trade
The protection covers companies engaged in renting or leasing. A private individual who lends a car is outside it entirely.
Courts apply the exceptions cautiously given the intent behind the provision, so these are lines of enquiry rather than assumptions. For how car accident claims work statewide, see the car accident practice area page.
Two things that matter more than the company's name
In most rental collisions the claim proceeds normally against different parties.

The driver and whatever stands behind them
The federal bar does not touch the claim against the person who caused the collision. What varies is the coverage behind them. A renter may have their own auto policy extending to a rental, may have purchased supplemental liability protection at the counter, or may have coverage through the credit card used to book. Establishing which of those exist, and their limits, is the practical work in a rental collision and it is frequently more productive than arguing about the company.
Whether verification technology was used
One area that has developed since the provision was enacted. In the early 2000s rental companies had limited ability to check a customer's driving record beyond looking at a licence. Verification systems are now widely available, and some courts have considered whether failing to use them can amount to negligence by the company. It is not a settled route and it is a genuine line of enquiry where a driver plainly should not have been given a vehicle.
Three rules about rented and leased vehicles
Federal law, applicable throughout New Jersey.
The bar on vicarious liability
An owner of a motor vehicle that rents or leases it shall not be liable under the law of any state, by reason of being the owner, for harm arising out of the use, operation or possession of the vehicle during the rental or lease period, provided the owner is engaged in that trade or business and there is no negligence or criminal wrongdoing on its part.
Its own conduct is not protected
The protection is expressly conditioned on the absence of negligence or criminal wrongdoing by the owner. Failure to maintain a vehicle the owner agreed to maintain, or renting to somebody plainly unfit, concerns the company's own conduct rather than its ownership, and falls outside the bar.
Different rules for a borrowed car
The provision protects businesses engaged in the trade of renting or leasing. Where a private individual lends their vehicle to somebody, that situation is governed by New Jersey's own framework on permissive use and coverage rather than by this federal bar.
Personal Injury Protection, the verbal threshold, the two year filing deadline and uninsured motorist claims are covered on the car accident practice area page and the Totowa personal injury page.
What to establish early
Ownership first, then coverage.
Identify the registered owner
The crash report records it. A rental or leasing company appearing there changes the analysis immediately.
Find out what coverage the driver had
Their own policy, any supplemental protection bought at the counter, and any coverage through the card used to book. Each may apply.
Ask about the vehicle's maintenance history
Where a mechanical failure contributed, the owner's own conduct is engaged and the federal bar does not protect it.
Check your own declarations page
Your medical benefits and uninsured motorist coverage matter more where the available liability coverage may be limited.

They handled everything, and all I had to do was listen, follow their guidance, and focus on my recovery. One of the best parts of the experience was working with the paralegal, John Velazquez. Whenever I had questions, he would stop what he was doing, sit down with me, and explain everything in detail. I never felt rushed, and I always felt that my concerns were fully answered.
