Hitting it and missing it are covered differently
.avif)
Morris County has the wooded roads riders come here for and the deer that go with them. When a strike happens on two wheels the consequences are severe, and the coverage rules are not intuitive.
Where your machine makes contact with an animal, that is treated as an other than collision event and falls under comprehensive coverage. The New Jersey Department of Banking and Insurance has put it plainly: damage to a vehicle from a deer or other animal is covered under an auto policy's optional comprehensive coverage, and a policy carrying only liability will not cover it. Comprehensive claims are generally treated as not at fault, so the effect on future premiums is ordinarily far smaller than an at fault collision. Now the part that catches people. If you swerve, miss the deer, and go down or strike something else, there was no contact with the animal, and that is ordinarily handled as a collision claim rather than a comprehensive one. Same deer, same road, different coverage and a different deductible. Riders who carry comprehensive but not collision can find themselves covered for the impact they did have and not for the one they avoided. None of that touches medical costs, which for a rider is the harder problem. New Jersey excludes motorcycles from its no fault medical benefits, so nothing pays your treatment automatically after a single vehicle animal strike. James Vasquez has handled New Jersey injury claims since 2004.
Rider claims we handle in Morris County
Some of these have a defendant and some do not, which is worth knowing at the outset.

Where Randolph riders come off
A township of wooded township roads with a commercial corridor across the top of it.
Dover Chester Road
Narrow with gradient and camber changes and no run off area, so a loss of grip has nowhere to go.
What matters: surface condition photographed before repair, since gravel and debris on these roads is a separate cause with a separate defendant.
Millbrook Avenue and the residential roads
Township roads through wooded lots where deer movement concentrates at first and last light, exactly when riders are commuting.
What matters: the time of day and the season, both of which the state's own guidance identifies as periods of heightened risk.
October to December
State guidance identifies mating season as October through December, with more incidents in October and November than the rest of the year combined.
What matters: that this is predictable rather than freakish, which matters where a road authority knew of a crossing and did nothing.
Sussex Turnpike
A rural connector with trees close to the carriageway and bends that hide what is standing at the edge until you are on it.
What matters: whether there was contact with the animal, because that single fact decides whether the claim is comprehensive or collision.
Route 10
Faster traffic with retail entrances and turning movements, where the ordinary right of way collisions happen rather than the animal ones.
What matters: the driver's obligation to yield to traffic close enough to be an immediate hazard, which is a fault question rather than a coverage one.
The County College approaches
Vehicles entering and leaving campus among through traffic, with drivers unfamiliar with the entrances making late decisions.
What matters: sight distance measured at the location, which answers the argument that a driver could not have seen you.
Riders come to these roads for the riding. The seasonal pattern is well documented, and it peaks in the months the riding is best.
Four things that decide it
Confirm against your own policy, because these are contractual terms rather than statutory ones.
Contact means comprehensive
Where your machine strikes the animal, insurers treat it as an other than collision event falling under optional comprehensive coverage.
No contact means collision
Swerve, miss it, and go down or hit something else, and it is ordinarily handled as a collision claim instead, with a different deductible.
Liability only means neither
The state's insurance department has said plainly that a policy carrying only liability will not cover damage from a deer collision.
Comprehensive is treated as not at fault
The effect on future premiums is ordinarily far smaller than an at fault collision claim, though repeated claims can still affect how a carrier views you.
Check your declarations page for both comprehensive and collision rather than assuming one implies the other. For how rider claims work statewide, see the motorcycle accident practice area page.
Two things a coverage answer does not solve
Property damage is the easy part of an animal strike on a motorcycle.

Nothing automatically pays your treatment
New Jersey excludes motorcycles from its no fault medical benefits, so unlike a car occupant you have no personal injury protection to open. After a single vehicle animal strike there is no other driver's liability coverage either. What remains is medical payments coverage on your own motorcycle policy if you bought it, and your health insurance. Riders discover this from a hospital billing department rather than from anyone beforehand, and treatment stalls while it is worked out.
There may still be a defendant
Not every animal case is a single vehicle case. Where you slowed or went down for a deer and a following driver struck you, that is an ordinary claim against them, and the requirement to keep a reasonably safe distance applies whatever caused you to slow. Where a car swerved for an animal into your lane, the deer explains that driver's conduct without excusing it. And where livestock or a domestic animal was loose, an owner may bear responsibility in a way that no one does for wildlife.
Three rules about animal strikes
Two are contractual and one is statutory. Confirm the first two against your actual policy.
Contact with an animal
The New Jersey Department of Banking and Insurance has stated that damage to a vehicle from a collision with a deer or other animal is covered under an auto policy's optional comprehensive coverage, and that a carrier will not cover such damage where only liability coverage is held.
Where you avoided the animal
Where a rider swerves, does not make contact, and then goes down or strikes something else, insurers ordinarily treat that as a collision claim rather than a comprehensive one. The distinction turns on physical contact and it carries a different deductible.
No medical benefits for riders
New Jersey's no fault framework defines automobile so as to exclude motorcycles, so no personal injury protection is available to a rider. After a single vehicle animal strike, medical payments coverage on your own policy and your health insurance are what remain.
Medical payments coverage, uninsured motorist claims and the two year filing deadline are covered on the motorcycle practice area page and the Randolph personal injury page.
What to do after an animal strike
Five minutes of documentation decides which coverage responds.
Record whether there was contact
Photograph the machine, the animal if it is present, and any hair or tissue on the bodywork. That evidence is what puts the claim under comprehensive.
Report it to the police
A report documents the incident for your insurer and gets the animal removed. It also matters where another vehicle was involved at any stage.
Check your declarations page for both coverages
Comprehensive and collision are separate. Carrying one does not mean carrying the other, and which applies depends on whether you made contact.
Sort out medical funding immediately
There is no personal injury protection for a rider. Establish whether you have medical payments coverage before treatment stalls over who is paying.

James Vasquez was the first name everyone recommended. People told me he would make sure I was taken care of, and they were right. The team was friendly, professional, down to earth, and experienced. They handled everything, and all I had to do was listen, follow their guidance, and focus on my recovery. One of the best parts of the experience was working with the paralegal, John Velazquez. Whenever I had questions, he would stop what he was doing, sit down with me, and explain everything in detail. I never felt rushed, and I always felt that my concerns were fully answered. After the accident at work, my health and my ability to work changed dramatically. I faced many challenges because I could no longer do the same things I used to do. Before receiving help, I was afraid because my health wasn't improving, and I didn't know what to do. The insurance company made things difficult, asking me questions I didn't know how to answer, and I felt lost and overwhelmed. Then I found this team, and from the very first conversation they gave me confidence and explained everything clearly. They guided me through the entire treatment process, helped me access the medical care I needed, and supported me every step of the way."
