How a compensation lien can swallow a settlement

This is the least discussed and most consequential part of a work related pedestrian claim, and it is worth understanding before anything is agreed.

The carrier has a statutory right to be repaid

New Jersey gives an employer or its compensation insurer a right to reimbursement out of a recovery obtained from a third party for the same injury. The principle is that you should not be compensated twice for the same loss. In practice it means a portion of what you recover from the driver goes back to the carrier that paid your medical treatment and wage benefits, and the amount is calculated by formula rather than negotiated from scratch.

The order in which claims resolve matters

Whether the compensation claim or the third party claim settles first affects how the reimbursement is calculated and therefore what reaches you. It is entirely possible for a substantial third party settlement to leave an injured person with very little once the lien and legal costs are accounted for.
