Most malpractice claims argue that treatment fell below the accepted standard. There is a separate federal claim that asks something more basic. Did the hospital examine you properly at all, and did it stabilise you before letting you leave?
Congress passed the Emergency Medical Treatment and Labor Act in 1986, largely to stop hospitals moving uninsured patients elsewhere without examining them. It requires any hospital with an emergency department that participates in Medicare, which is very nearly all of them, to provide an appropriate medical screening examination to anyone who comes in and asks for care. If that screening reveals an emergency medical condition, the hospital must either stabilise it within its capabilities or arrange an appropriate transfer. It applies regardless of insurance, immigration status, or ability to pay, and the screening must come before any discussion of payment. Crucially, the statute gives an injured person a right to sue the hospital directly. That is a claim against the institution rather than against an individual physician, and it asks whether the hospital did what the law required rather than whether a doctor exercised reasonable clinical judgment. The two questions are related and they are not the same. The deadline is generally two years from the violation. These obligations come from federal statute rather than from professional custom, which makes them measurable in a way ordinary negligence often is not.
It applies regardless of status
Insurance, immigration status, national origin and ability to pay are all irrelevant to the duty. It applies to anyone who walks through the door.

How the federal claim differs from ordinary malpractice
They can arise from the same visit and they are proved differently. Knowing which applies shapes the whole case.
The defendant is the hospital
The federal statute creates a right of action against the hospital itself rather than against an individual clinician. That matters where the physicians involved were employed by a contracted group rather than by the hospital, because the institution answers for compliance with the statute regardless of who it employs. An ordinary negligence claim against a treating doctor may proceed alongside it.
The question is compliance, not clinical judgment
Ordinary malpractice asks whether a provider departed from the accepted standard of care in their specialty. The federal claim asks whether the hospital provided an appropriate screening examination and stabilised an emergency condition. A hospital can be liable for failing to screen consistently even where no individual doctor made a diagnostic error, which is a genuinely different route.
The procedural requirements differ
New Jersey's affidavit of merit requirement applies to professional negligence claims against licensed practitioners and facilities. How it interacts with a federal statutory claim is a question to resolve at the outset with counsel rather than assumed either way, because the answer affects filing strategy and timing. Both routes carry a two year period, running from different events.
Three rules that govern emergency care claims
One is federal and specific to emergency departments. Two are the New Jersey requirements that apply to malpractice generally.
Screening, stabilisation and transfer
The Emergency Medical Treatment and Labor Act requires Medicare participating hospitals with emergency departments to provide an appropriate medical screening examination to anyone requesting care, to stabilise any emergency medical condition found within their capability, and to transfer only in defined circumstances. It provides an injured person a right to sue the hospital, generally within two years of the violation.
The affidavit of merit
For professional negligence claims, an affidavit from an appropriately credentialed professional must be served within 60 days of the defence answer, with one possible extension for good cause. Failure generally means dismissal with prejudice. How this applies where a federal statutory claim is also pleaded should be addressed at the outset.
The expert must match the specialty
New Jersey requires the affidavit and trial testimony to come from someone credentialed in the same specialty as the defendant, with equivalent board certification where the defendant holds it. In emergency care claims that means an emergency physician rather than a generalist.
