Firms say they work with accident reconstruction specialists. Almost none explains what that actually means, which leaves riders assuming it is a formality rather than the thing that decides their case.

And the car itself may hold recorded data, because most modern passenger vehicles capture information in the seconds before a crash, including speed, braking and throttle. A driver who insists they stopped and looked can be contradicted by their own vehicle. That data does not survive indefinitely. The car gets repaired, sold or scrapped. Narrow streets parked on both sides, where a driver at a stop line genuinely cannot see far enough and pulls out into a gap that was never there.
How it gets proved: sight distance measured at the location. What a driver could actually see from that seat, at that stop line, is a measurable fact.
Monroe Street and the school approaches
Vehicles dropping off and circling for parking, pulling from the kerb without checking, on streets with steady foot traffic.
How it gets proved: independent witnesses, whose details have to be captured at the scene because they are unfindable afterward.
In each of these the evidence that answers the speed allegation is physical and perishable. The vehicles get repaired, the marks wash away, and the footage cycles.
Six sources that outrank anybody's estimate
This is what reconstruction means in practice, and it is why the driver's account of how fast you were going is a starting point rather than a finding.
Every one of these depends on access to vehicles and a scene that have not yet been repaired, cleared or resurfaced. Three things in your file that only look like facts
Each of these carries weight it has not earned, and each can be displaced by something measurable.
The driver's speed estimate
A person who did not see a motorcycle at all has no basis for judging how fast it was travelling. What they are usually doing is working backwards from how severe the impact felt, which produces an inflated figure and does so honestly. It is an impression rather than an observation, and physical evidence displaces it.
The officer's diagram
Crash diagrams are prepared quickly, often at night, in traffic, by someone managing an active scene rather than conducting a reconstruction. Positions are approximate by necessity. They are a useful record of what was observed and they are not a measurement, which matters because a diagram showing a motorcycle in the wrong position follows a claim for years.
A witness who arrived after the noise
Most people at a crash scene heard it and then looked. What they genuinely remember is the aftermath, and recollection fills the gap before it in good faith. Independent witnesses who actually saw the approach are valuable and rare, which is why their details need capturing at the scene.
Three rules that decide right of way cases
These sit alongside the ordinary rider rules and they are what a left turn or pull out claim turns on.
Yielding at intersections
New Jersey sets out who must yield where vehicles approach or enter an intersection, including the obligation on a driver turning left to yield to oncoming traffic close enough to constitute a hazard. A motorcycle in that oncoming lane is traffic, and the duty does not soften because the vehicle was small.
Speeding is their allegation to prove
Comparative negligence reduces a recovery by the share of fault attributable to you, and bars it only above half. But an allegation that a rider was speeding is a contention that has to be supported, not a default position. Where the physical evidence does not support it, it should not survive.
Riders stay outside the no fault system

What preserves the physical evidence
All of this is perishable, and most of it disappears within weeks.
Ask that the other car be preserved
A written request that the vehicle not be repaired or disposed of before its recorded data can be downloaded. Once it is fixed or sold, that record is generally gone.
Photograph the road surface
Skid, scuff and gouge marks, with something in frame for scale. Rain and traffic remove them within days and they establish braking and point of impact.
Keep the motorcycle unrepaired
Scrape patterns and crush establish speed, angle and whether you were upright or already down. Do not authorise disposal.
Capture witness details at the scene
Anyone who actually saw the approach rather than the aftermath. If you were unable to at the time, the crash report may list them and it is worth checking early.
Note the exact location
Sight distance is measured from a specific stop line at a specific angle. A precise location makes that possible months later.
