Families who suspect a nursing home has harmed a relative usually assume they face the same uphill task as any malpractice claim. Expert reviewers, standard of care, causation. Some of that is true, and there is also a separate route that most people never hear about.

In 1976 New Jersey enacted legislation setting out the responsibilities of nursing homes and the rights of their residents. Those rights are specific and statutory. They include the right to a safe and decent living environment, considerate and respectful care recognising the dignity and individuality of the resident, appropriate assessment and management of pain, freedom from medication used for punishment or staff convenience, and the right to raise grievances without any threat of reprisal. Crucially, the Act provides that a person or resident whose rights are violated has a cause of action against whoever committed the violation. It also contains a fee shifting provision, meaning the costs of enforcing those rights can be recoverable, which alters the economics of pursuing a case that might otherwise be uneconomic to bring. The scope of that provision has been the subject of recent appellate attention, so its current application should be confirmed rather than assumed. None of this displaces an ordinary negligence claim, and the two are frequently pursued together. It does mean the first question in a long term care case is not only what the standard of care required but what the statute guaranteed. The points at which long term care fails

Each of these produces documentation, which is what makes these cases provable when the records are obtained early.

The care plan

A written plan setting out the interventions this resident requires, including turning schedules, assistance levels and monitoring.

What the record shows: the gap between what the plan required and what the daily notes record as delivered. That gap is the case.

Charting by exception

Long term care charts frequently record only deviations, so an absence of entries can be as informative as their content.

What the record shows: missing turning entries, missing intake records or missing observations during the period when a condition developed.

Transfer and discharge

Residents have rights concerning notice and the circumstances in which they may be transferred or discharged.

What the record shows: whether required notice was given and whether the stated reason matches what the clinical record supports.

The admission assessment

On arrival a resident is assessed for mobility, skin condition, nutrition, cognition and risk. Everything afterwards is measured against it.

What the record shows: the facility's own view of what this person needed on day one. A decline from that baseline is far harder to attribute to age alone.

Staffing and shift records

Whether enough staff were present to deliver the care the plans called for, on the shifts when the harm occurred.

What the record shows: a pattern rather than an incident. Chronic understaffing appears across rosters and it explains failures that otherwise look isolated.

Change in condition

A recorded deterioration should trigger notification of a physician and the family, and a decision about transfer.

What the record shows: how long a documented change went unescalated. That interval is frequently the difference between a treatable condition and a fatal one.

In every one of these the evidence already exists in the facility's own records, which is why obtaining the complete file promptly matters more than anything else.

How a rights claim differs from ordinary negligence

They overlap and they are not the same, and understanding the difference shapes how a case is built.

Negligence asks about the standard of care

The familiar route. It requires establishing what a reasonably competent provider would have done, that the facility fell below it, and that the failure caused harm the underlying condition would not have produced anyway. Where professional negligence is alleged against a licensed facility, New Jersey's affidavit of merit requirement applies, meaning a properly credentialed professional must certify the claim within 60 days of the defence answer.

The statutory route asks what was guaranteed

Rather than reconstructing a standard from expert evidence, this route starts from rights the legislature wrote down. A resident whose statutory rights were violated has a cause of action, and the Act contains a fee shifting provision that can make a case viable which would otherwise cost more to prove than it could recover. The scope of that provision has been considered by the Appellate Division recently, so its current application should be confirmed.

In practice they are pleaded together

Most long term care cases involve both, because the same facts frequently establish a departure from the standard of care and a violation of statutory rights. The records that prove one generally prove the other, which is why the complete file is requested at the outset rather than after a theory has been chosen.

Three rules for long term care claims

Two create the statutory route. One is the requirement that applies to professional negligence generally.

A resident whose rights are violated may sue

The Nursing Home Responsibilities and Rights of Residents Act provides that any person or resident whose rights as defined in the Act are violated has a cause of action against any person committing the violation. It is a route distinct from ordinary negligence, though the two are frequently pursued together.

Costs of enforcement can shift

The Act contains a provision addressing the costs and fees of enforcing residents' rights. That materially changes the economics of pursuing cases which would otherwise cost more to prove than they could recover. The provision's scope has been the subject of recent appellate consideration, so confirm the current position.

N.J.S.A. 2A:53A-27

The affidavit of merit still applies

Where professional negligence is alleged against a licensed facility or practitioner, an affidavit from an appropriately credentialed professional must be served within 60 days of the defence answer, with one possible extension for good cause. Failure generally means dismissal with prejudice.

What to request, and in what order

The facility's own records decide these cases, and families are entitled to them.

Request the complete record in writing

Use those words. Ask by name for the admission assessment, all care plans and revisions, nursing notes, medication administration records and incident reports.

Ask for the assessments specifically

Fall risk, skin integrity, nutrition and cognition assessments, including every reassessment. These establish what the facility itself knew about the risk.

Photograph any visible injury

Wounds, bruising and weight change, dated. Facilities document these variably and a family's own record is frequently better.

Write down what staff told you and when

Explanations given at the time, and who gave them. Accounts firm up considerably once a complaint is made.

Consider a regulatory complaint separately

The Department of Health investigates facilities and the Ombudsman for the Institutionalized Elderly assists residents. Neither extends any legal deadline.

Request the complete record in writing. A resident, or an authorised representative, has a right of access, and the request should name the documents rather than being general.

New Jersey Department of Health

Licenses and inspects long term care facilities and investigates complaints. Findings and inspection history become part of the available record.

Office of the Ombudsman for the Institutionalized Elderly

Referenced in the statute itself, this office assists residents in asserting their rights and must be given access to facilities.
