Brain injury claims are usually built around what is measurable in the first year. Cognitive testing, imaging, functional limitation. What gets missed is that some of the most consequential effects appear well after that window closes.

What a seizure diagnosis changes, including your licence

This is the part nobody explains in advance, and it deserves stating accurately rather than gently.

Physicians have a reporting obligation

New Jersey requires a treating physician to notify the Motor Vehicle Commission after determining that a patient experiences recurrent convulsive seizures, recurrent periods of unconsciousness or impairment, or loss of motor coordination from a condition persisting despite treatment. A licence holder is also required to report the condition. This is not something a doctor chooses to do to you, and it is not something to be avoided by concealing symptoms, which would be dangerous as well as futile.

Driving privileges are conditional on being free of it

New Jersey's regulations require a person who has had such a condition to satisfy the Motor Vehicle Commission that they have been free of it for at least six months, which may be with or without medication. Cases may be reviewed by a medical panel, and outcomes range from no action through restriction to suspension. Legislation has been proposed to update the terminology used, so the current position should be confirmed.

Losing the ability to drive is a recoverable loss

It is not a side issue. Loss of driving affects employment, independence, childcare and the cost of everything from shopping to medical appointments, particularly outside the main transit corridors. Where it results from the injury it is a compensable consequence, and it should be quantified properly rather than mentioned in passing.

Accepting a settlement and signing a release ends the claim for all consequences of the injury, including those diagnosed afterwards. There is no mechanism for reopening it because a condition emerged later. That is the single most important thing to understand before agreeing a figure.
