Two distinctions the law draws
They look technical and they decide whether any insurance exists.
Muscle power versus a motor
New Jersey's no fault framework turns on whether something is propelled by muscular power. An ordinary bicycle is, which is why cyclists are treated as pedestrians for benefit purposes and why there is no auto insurance behind a bicycle. A machine with a motor is not, and the Supreme Court has held that a rider of a low speed electric scooter does not fall within the definition of pedestrian under the no fault framework. That decision concerned what a rider can claim, and the same distinction runs through the question of what exists behind a machine that strikes somebody.
The 2026 changes
New Jersey enacted legislation in 2026 requiring registration, licensing and liability insurance for electric bicycles, with a grace period running into July of that year. Reported detail on minimum limits and precise requirements varies between sources, and insurers and the state are still working through the arrangements. What that means practically is that whether a policy exists behind the machine that struck you depends partly on when it happened and whether the rider complied. Every motorized bicycle liability policy issued in this State must provide personal injury protection benefits, in accordance with the no fault provisions, to pedestrians who sustain bodily injury in this State caused by the named insured's motorized bicycle or caused by being struck by or from it.
Insurance is required
Owners of motorized bicycles principally garaged or operated in New Jersey, and every business or individual in the business of renting them, must maintain liability insurance against loss resulting from liability for bodily injury, death and property damage arising out of ownership, operation or use.
Motorised riders are not pedestrians
The New Jersey Supreme Court held that a rider of a low speed electric scooter does not fall within the definition of pedestrian for no fault purposes, because the machine is propelled by other than muscular power. The distinction between muscle powered and motorised runs throughout this area.

What to do at the scene
Identification matters more here than in any other pedestrian case.
Get the rider's name and address
A bicycle has no registration plate. If the rider leaves without identifying themselves, tracing them afterwards is genuinely difficult.
Photograph the machine
Whether it has a motor, a throttle, a battery or a registration label determines which framework applies and whether insurance was required.
Take witness details immediately
