A route to benefits riders are rarely told about
.avif)
Nutley sits between two highways carrying heavy traffic toward New York, so a substantial share of collisions here involve a driver insured somewhere else. For a rider, that can matter in an unexpected way.
New Jersey's deemer statute requires any insurer authorised to transact motor vehicle insurance business in this State, or under common control with one, which sells a policy in another state, to include coverage satisfying at least New Jersey personal injury protection benefits for any New Jersey resident who is not required to maintain such coverage and who is not otherwise eligible for those benefits, whenever the insured vehicle is used or operated in this State. Read that description again. A New Jersey motorcyclist is not required to maintain personal injury protection, because motorcycles are excluded from the definition of automobile, and is not otherwise eligible for it. So where an out of state vehicle insured by a carrier authorised here is used or operated in New Jersey and injures a rider, that clause is worth examining rather than assuming there is nothing. It is not automatic. The carrier must be authorised in New Jersey or under common control with one that is, and the courts have held that the statute applies only where there is a substantial connection between the use or operation of the insured out of state vehicle and the accident. A vehicle that was parked and not in use has been held not to satisfy that. These questions turn on the specific policy and the specific facts, and they should be assessed rather than assumed either way. James Vasquez has handled New Jersey injury claims since 2004.
Rider claims we handle in Essex County
Cross border collisions raise coverage questions ordinary ones do not.

Where Nutley riders go down
A township grid with two highways at its edges carrying traffic from several states.
Route 21
Traffic moving between highway and local speeds across short distances, where drivers misjudge a motorcycle's closing speed.
What to establish: physical evidence of actual speed, since drivers routinely overestimate how fast an approaching motorcycle was travelling.
Centre Street and Washington Avenue
Intersections where drivers commit late and a motorcycle is the hardest approaching vehicle to pick out.
What to establish: the driver's obligation to yield, which does not depend on whether they actually perceived you.
Park and river approaches
Roads around Yanticaw Park and the Third River where recreational traffic mixes with through movements at weekends.
What to establish: camera coverage from nearby premises, which records continuously and overwrites within days.
Route 3
A corridor carrying heavy volume toward the crossings into New York, with a large share of vehicles insured outside New Jersey.
What to establish: which state the policy was written in and whether that carrier is authorised here, because the deemer statute turns on exactly that.
Franklin Avenue
The main commercial street with turning movements into side streets and service entrances among parked cars and pedestrians.
What to establish: sight distance measured at the location, which answers an account of not being able to see you.
The residential grid
Narrow streets where vehicles emerge between parked cars with a few metres of visibility in either direction.
What to establish: whether a reasonable driver could have entered safely at all, which is a question about their decision rather than your presence.
In each of these the first practical question is what insurance stands behind the other vehicle, and where it was written.
Four things riders should know about it
Confirm the position on your specific facts, because this turns on the policy and the circumstances.
Written for people with no PIP
The statute addresses coverage for any New Jersey resident who is not required to maintain personal injury protection and is not otherwise eligible for those benefits. That describes every rider in this state.
The carrier must be authorised here
It applies to insurers authorised to transact motor vehicle insurance business in New Jersey, or controlled by or under common control with one that is.
The vehicle must have been in use here
Courts have required a substantial connection between the use or operation of the insured out of state vehicle and the accident. A parked vehicle has been held not to satisfy that.
The usual trade off does not bite
For a car driver the deemer statute brings benefits along with the verbal threshold. Riders are not subject to that threshold, so the trade off that concerns drivers does not apply in the same way.
Establishing where the other driver's policy was written, and whether that carrier operates here, is a first week question rather than a technicality. For how rider claims work statewide, see the motorcycle accident practice area page.
Two things worth establishing immediately
Both shape the case more than anything about how the collision happened.

The minimum has been rising
New Jersey's minimum bodily injury coverage has increased in stages, from fifteen thousand dollars per person for policies issued or renewed before 2023, to twenty five thousand for those issued or renewed from January 2023, and to thirty five thousand for those issued or renewed from January 2026. The controlling date is the policy's issue or renewal date rather than the date of the crash, so two drivers in the same collision can carry different minimums. It is worth checking rather than assuming the old figure.
Where the policy was written changes things
Under the deemer statute an out of state policy issued by a carrier authorised here is treated as guaranteeing New Jersey's minimum bodily injury limits, and the Supreme Court confirmed in 2020 that the creation of the basic policy option did not change that. Where the carrier is not authorised here, the statute does not apply, and the claim proceeds against the out of state policy on its own terms with your own uninsured or underinsured coverage behind it.
Three rules about out of state drivers
Confirm current provisions and how they apply to your facts.
The deemer statute
Any insurer authorised to transact motor vehicle insurance business in this State, or under common control with one, which sells a policy in another state, must include coverage satisfying at least New Jersey personal injury protection benefits for any New Jersey resident who is not required to maintain such coverage and is not otherwise eligible for those benefits, whenever the insured vehicle is used or operated in this State.
The vehicle must have been in use
The Appellate Division has held that the statute applies only where there is a substantial connection between the use or operation of the insured out of state vehicle and the accident. A vehicle that was parked and not in use did not satisfy that requirement.
Why riders have no benefits to begin with
New Jersey's no fault framework excludes motorcycles from the definition of automobile, so no personal injury protection is available to a rider under their own policy. That exclusion is what places riders within the description the deemer clause addresses.
Medical payments coverage, uninsured motorist claims and the two year filing deadline are covered on the motorcycle practice area page and the Nutley personal injury page.
What to establish in the first week
All of it concerns the other vehicle's insurance.
Find out where the policy was written
The crash report records the insurance presented. Which state issued it, and whether that carrier operates in New Jersey, is the threshold question.
Check the other driver's limits and renewal date
New Jersey's minimum has risen in stages and the controlling date is the policy's issue or renewal, not the crash.
Read your own declarations page
Medical payments coverage and uninsured or underinsured limits matter more to a rider than to anyone else on the road.
Preserve the machine and the scene evidence
Speed, angle and sight distance answer the arguments that follow, and all three disappear within weeks.

They handled everything, and all I had to do was listen, follow their guidance, and focus on my recovery. One of the best parts of the experience was working with the paralegal, John Velazquez. Then I found this team, and from the very first conversation they gave me confidence and explained everything clearly.
