Carriers must verify licensing, medical fitness, employment history and driving record before putting someone behind the wheel, and must keep that file. Where a carrier hired or kept a driver it should not have, the file establishes an independent claim against the company rather than merely against the driver.

Interstate carriers must maintain minimum liability coverage that has not kept pace with the cost of catastrophic injury, with higher minimums for hazardous materials. In a serious crash the primary policy is often exhausted, which is precisely why additional defendants and excess coverage have to be identified early.
