Truck claims usually examine what a driver did. A newer question asks something earlier, which is whether they were ever properly taught to do it at all.
The entry level driver training rule took effect on 7 February 2022. Since then, anyone obtaining a Class A or Class B commercial licence for the first time, upgrading to a higher class, or obtaining a school bus, passenger or hazardous materials endorsement for the first time must complete a prescribed programme before taking the skills test. That programme covers theory and behind the wheel instruction on a range and on public roads, and it must be delivered by an entity listed on the federal Training Provider Registry. What makes it useful in a claim is that it is verifiable. Providers must submit certification records to the registry within two business days of completion, and state licensing agencies must check the registry before administering the test. So there is a record of whether a driver completed the required training and which provider certified it. Four things the 2022 rule established
Confirm current requirements against the federal registry, because guidance is updated.
First time applicants and upgrades
Anyone obtaining a Class A or B licence for the first time, upgrading to a higher class, or seeking a school bus, passenger or hazardous materials endorsement for the first time.
Theory and behind the wheel
A prescribed curriculum covering knowledge instruction and practical training on a range and on public roads, completed before the skills test.
Registered providers only
Training must come from an entity listed on the federal Training Provider Registry. Providers must submit certification records within two business days of completion.
Licences before February 2022 are exempt
A driver holding a commercial licence or endorsement issued before that date is not subject to the requirement, even if it later lapsed.

Two questions the records answer
One about the driver, one about the company that hired them.
Whether the training actually happened
The registry records which provider certified a driver's completion, which makes the training checkable rather than assumed. Where a provider certified large numbers of drivers with little apparent activity, or where certification and licensing followed one another implausibly quickly, that is a line of enquiry rather than a conclusion. The federal agency itself monitors providers that submit no certifications over extended periods.
What the carrier verified before hiring
A company that puts a driver on the road remains responsible for its own hiring and training decisions, separately from whatever the licensing system required. Where a carrier engaged a newly qualified driver and provided no additional familiarisation with the specific vehicle, the route or the task, that is a claim against the company rather than only against the person driving.

Entry level driver training
Since 7 February 2022, entry level drivers must complete prescribed theory and behind the wheel training before taking the commercial skills test, delivered by a provider listed on the federal Training Provider Registry. The requirement also applies to first time school bus, passenger and hazardous materials endorsements.
The record is checkable
Providers must submit driver training certification records to the registry within two business days of completion, and state licensing agencies must verify completion before administering the relevant test. That produces a verifiable record of whether training occurred and who certified it.
The carrier answers for its own decisions
Separately from any licensing requirement, a company is responsible for its own conduct in hiring, training and supervising drivers. Where it engaged someone it knew or should have known was not competent for the task, that is a claim against the business proved from its own records.

What to establish early

Establish when the driver was licensed
It determines whether the training requirement applied at all. A licence issued before February 2022 is outside it.
Demand the carrier's driver file
Including what it verified about training and qualification before hiring, and any familiarisation it provided afterwards.
Send the preservation demand promptly
Naming logging data, telematics, camera footage and the driver qualification file, all of which cycle on defined retention periods.
Identify the operating carrier correctly
