Montclair's own ordinance is specific. Anybody who opens or excavates a street in the township must thoroughly and completely refill the opening, and the surface must be restored to the same condition as it was before, in accordance with township requirements and the specifications of the state transportation department. As restored, the surface must conform to the part of the street immediately adjoining the opening. The ordinance also provides that no opening may extend beyond the centre line of the street until the surface is restored to a condition safe and convenient for travel. It goes further. Where defects appear in the restored surface resulting from defective workmanship by the permittee, that party must reimburse the township for the cost of the necessary repairs plus fifteen percent. That is an ordinance recognising that trench repairs fail, and placing the consequence on whoever did the work. Across New Jersey municipalities the pattern is the same. Permittees assume liability and responsibility arising from the street opening, including the opening itself, the construction operations, traffic safety and control and the restoration, and hold the municipality harmless. They file certificates of liability insurance and post performance and maintenance guarantees, and they remain responsible for the site for a maintenance period after the permanent repair. Four things a road opening permit carries
Requirements vary by municipality. These are the common pattern and the township's own ordinance should be checked.
Assumed liability
Permittees commonly accept, as a condition of the permit, all liability arising from the opening, the construction operations, traffic safety and control and the restoration, holding the municipality harmless.
Insurance and guarantees
A certificate of liability insurance is ordinarily required, along with performance and maintenance guarantees, which means there is a policy behind the work.
A restoration standard
Montclair requires the surface to be restored to the same condition as before, conforming to the adjoining street, to township and state specifications.
A maintenance period
Municipalities commonly hold the permittee responsible for the site for a period after permanent restoration, and Montclair's ordinance addresses defects from defective workmanship directly.

Photograph the defect the same day
The single most useful thing a rider can do is record the condition with something in frame for scale, showing the depth of the settlement or the height of the plate edge. A trench repair that caused a collision is frequently repaired within days precisely because the collision drew attention to it. Photographs also establish the extent of the cut, which is what the permit records will be matched against when identifying who did the work.
Assume the ninety day clock until told otherwise
Where a public entity may share responsibility, a notice of claim is generally required within ninety days, and it cannot be recovered once missed. The claim against a private permittee is subject to the ordinary period instead. Because the identity of the responsible party is exactly what has to be established from the permit records, the safe course is to work to the shorter deadline while that is being done.

Note any markings or signage
