The provision excludes from gross income the amount of any damages received, whether by suit or agreement and whether as lump sums or as periodic payments, on account of personal physical injuries or physical sickness. Periodic payments were added expressly by legislation in 1982. So the money is not taxable on receipt either way, and any page telling you a lump sum is taxable and a structure is not has simply misstated it.
The difference is what happens next
Once a lump sum is received and invested, the returns on that investment are ordinary taxable income, year after year, for as long as the money is invested. Where payments are structured through a qualified assignment, the growth built into the funding annuity remains inside the exclusion and each scheduled payment arrives without being reported as income. That gap is the entire financial case for structuring, and it depends on time.
Where the exclusion does not reach
It is directed at damages for physical injury or physical sickness. Punitive damages, and claims that are not for physical injury, can fall outside it, and where a settlement includes such components they should be identified and dealt with separately rather than assumed to share the same treatment. This is an area where a tax professional should be involved rather than a lawyer alone.

Federal law preserves the original tax treatment where structured settlement payments are sold, and imposes a substantial excise tax on any buyer who proceeds without court approval. That approval requirement exists to protect recipients from disadvantageous transactions.
