A brain injury from an assault leaves an injured person in a peculiar position. Liability is obvious and the defendant is frequently untraceable, uninsured or in custody, which means the obvious claim is worthless.

New Jersey provides another route. A possessor of land who holds it open to the public owes a duty to take reasonable action to protect visitors against unreasonable risk of physical harm, and that duty extends to harm inflicted by other people. The New Jersey Supreme Court has held that a business owes ordinary care to protect invitees from injury inflicted by individuals the owner could reasonably have foreseen might be present. The important part is how foreseeability is tested. In 1997 the Supreme Court adopted the totality of the circumstances approach and rejected a strict requirement of prior similar incidents on the property. Its reasoning was direct. The mere fact that a particular kind of incident had not happened before is not a sound reason to conclude it could not reasonably have been anticipated, and tort law does not generally require the first victim to lose while later victims get to a jury. So a property owner is not entitled to one free assault. Whether a duty arose is assessed on everything about the location, what was around it, what security existed, and what the surrounding area was like. The absence of any security provision for a large public car park was central to the Court's analysis of what a reasonable owner would have done.

Why it counts: an owner who provided nothing at all is in a materially different position from one whose measures proved inadequate.

Cameras, or their absence

There was no surveillance camera covering the area. Its absence was part of what made the risk unaddressed rather than merely unlucky.

Why it counts: it goes both to foreseeability and to what reasonable care required, and it is easily established by inspection.

The pattern in the area

Repeated incidents in the immediate vicinity, or a marked increase in a community, can establish foreseeability even without prior incidents on the site.

Why it counts: the Court expressly contemplated this, which is why an owner does not get one free assault before any duty arises.

What sits next door

In the leading case the supermarket adjoined a liquor store and a petrol station. What neighbours a property affects who is predictably present and at what hours.

Why it counts: foreseeability is assessed on the whole picture rather than on the property in isolation, and adjacent uses are part of that picture.

Blind areas and sight lines

The victim was taken from a part of the lot beside a windowless section of the building, against a solid concrete wall with no view from inside.

Why it counts: a location that cannot be observed from anywhere is a design feature rather than an accident, and it was expressly considered.

Warnings to visitors

No warning of any kind was given to customers using the area. Where an owner knows of a risk, informing visitors is among the cheapest available responses.

Why it counts: the absence of a warning is evidence that a known risk was not addressed even at minimal cost.

Every one of these is established by inspection, photographs and records rather than by argument, and most of them change once litigation is anticipated.

Prior incidents, and why New Jersey did not require them

Other states took the narrower route. Understanding the difference explains why these claims are viable here.

The rule New Jersey rejected

Some jurisdictions require a plaintiff to show prior similar criminal incidents on the defendant's premises before any duty to provide security arises. The consequence is that the first person attacked at a location automatically loses, however obvious the risk was, and only later victims can recover. New Jersey's Supreme Court declined to adopt that approach, and the Appellate Division opinion it drew on described such a rule as inherently unfair and contrary to public policy.

What the totality approach considers instead

Actual knowledge of criminal activity on the property, constructive notice based on what an owner should have known, the nature and location of the business, the character of the surrounding area, and the practicality and cost of measures that could have been taken. It is a broader enquiry, and it means evidence about the neighbourhood and the design of the property both count.

Where it still fails

The test is not a guarantee. The Appellate Division in the same litigation had found the evidence insufficient before the Supreme Court reversed, and courts do dismiss these claims where the risk genuinely was not foreseeable and the measures suggested were disproportionate. An honest assessment looks at what a jury could reasonably conclude rather than at what happened.

Totality of the circumstances

The New Jersey Supreme Court held that a business owes invitees ordinary care to protect them from injury inflicted by individuals the owner could reasonably have foreseen might be present, and adopted the totality of the circumstances approach rather than requiring prior similar incidents on the premises.

A duty arising from status

A possessor of land who holds it open to the public is under a duty to members of the public who enter in response to that invitation to take reasonable action to protect them against unreasonable risk of physical harm. The Court relied on this in framing the duty.

Licensed Premises

No liability free first incident

New Jersey has held that a tavern owner serving a visibly intoxicated patron is not entitled to a liability free first accident, nor to a free criminal assault committed by such a patron. Where an assault followed service of alcohol, that is a separate route alongside the premises claim.

Lighting, sight lines, blind areas, camera positions, signage and what adjoins the property. Owners improve these promptly once a claim is anticipated.

Guards, patrols, entry controls or none. What existed at that hour rather than what a website advertises.

Report it to the police and the owner

Both. A police report matters independently, and an incident report to the owner creates a dated record you can later request.

Ask about footage in writing within days

Where cameras existed, footage overwrites quickly. Where they did not, establish that too, because their absence is part of the case.
