A pedestrian crossing outside a crosswalk must yield to vehicles. That does not hand the driver a defense. It makes the case a comparative fault case, where your share reduces the recovery and only bars it if it exceeds half.

A last resort with an early deadline

Where a pedestrian is struck by an uninsured or unidentified driver and has no other coverage available, New Jersey's fund may respond. It requires notice far sooner than the ordinary filing deadline, which is measured in months rather than years, and missing it forfeits the remedy.
