Hackensack is where Bergen County goes for care, and where these claims begin

A malpractice claim is not a complaint about a doctor you did not like. It is a specific legal assertion that a provider fell below the accepted standard of care and that the failure, rather than the underlying illness, caused your harm.

That second half is where most cases turn. A patient who was already seriously ill, received imperfect care, and then got worse has a genuine grievance and often no viable claim, because the defense will argue the outcome was always coming. Separating the harm the negligence caused from the harm the disease caused is the entire analysis, and it takes a physician reviewer to do it honestly before anyone files anything. New Jersey then layers procedure on top. Within 60 days of the defense filing its answer, you must serve an affidavit of merit from a licensed professional who is credentialed in the same specialty as the defendant. The court schedules a conference specifically to confirm this was done. Miss the window without a good reason and the dismissal is usually with prejudice, which ends the case permanently regardless of how strong the medicine was. James Vasquez has represented injured people across Bergen County since 2004. He is direct about which cases clear these hurdles and which do not, because telling someone early that a claim will not survive is more useful than filing it and letting a procedural deadline end it eighteen months later.

Medical malpractice claims we handle in Hackensack

Each of these requires a different specialty of expert reviewer, which affects both timing and cost.

Where Hackensack malpractice claims arise, and what the defense argues

The setting shapes the claim. It determines which records exist, who employed the provider, and which specialty of expert has to sign the affidavit.

Operating rooms and surgical centers

Most surgical complications are known risks that were disclosed and are not negligence. The claims worth bringing are the ones where the injury sits outside the recognized risk profile or where the operative note and the anatomy do not reconcile.

What the defense argues: that this is a known complication you consented to. The consent form, the operative report and the specialty standard have to be read together.

Radiology and pathology reads

Unlike most malpractice claims, the evidence here does not depend on anyone's memory. The imaging or the slide can be given to an independent reader who does not know what happened next.

What the defense argues: hindsight bias, meaning the finding is only obvious once you know the outcome. A blinded second read answers that directly.

Long term care and rehabilitation

Facility claims turn on the nursing record. Turning schedules, fall risk assessments and weight logs either exist or they do not, and gaps in routine charting are themselves evidence.

What the defense argues: that the decline was expected given the resident's condition. Baseline assessments on admission establish what was actually expected.

The hospital emergency department

As the seat of Bergen County, Hackensack draws emergency volume from across the region. Time critical presentations get sorted quickly, and the claims that follow usually involve a symptom pattern that was documented but not acted on.

What the defense argues: that the presentation was atypical and the decision was reasonable at the time. Vital sign trends and triage notes recorded across the visit are what test it.

Labor and delivery

These claims are built on the fetal monitoring strip and the minutes between a concerning tracing and the decision to intervene. The record is unusually precise, which cuts both ways.

What the defense argues: that the injury was congenital or occurred before presentation. Cord blood gases and placental pathology are frequently decisive.

Outpatient practices and referral chains

An abnormal result returned to a practice, was filed, and nobody called the patient. Or a referral was made and never scheduled. These are systems failures and they are documented in the chart's audit trail.

What the defense argues: that the patient failed to follow up. The electronic record's access log shows who saw the result and when.

In every setting, the useful evidence is the complete record rather than the summary the facility offers. That includes nursing notes, medication administration records, imaging on disc rather than as a report, and the electronic chart's audit trail showing who accessed what and when.

Three reasons New Jersey malpractice claims die before a jury sees them

Not one of these is about whether the care was actually negligent. They are the reasons meritorious claims never get evaluated on the medicine.

The expert was not credentialed correctly

New Jersey requires the affidavit and the trial testimony to come from someone who practices in the same specialty as the defendant, and where the defendant is board certified, from someone with equivalent certification. A well regarded physician in an adjacent field is not sufficient. Retaining the wrong reviewer wastes the window and the money spent on the review.

Causation was never separated from the illness

Proving substandard care is only half of it. You also have to show the substandard care caused a harm the underlying condition would not have produced anyway. Where a patient presented late with advanced disease, that gap is often unbridgeable, and an honest reviewer will say so before a complaint is drafted.

The record was incomplete when the reviewer read it

Facilities routinely produce a discharge summary and call it the chart. Nursing notes, medication administration records, imaging studies themselves, telemetry data and the electronic audit trail are where departures actually show. A reviewer working from a summary can miss a viable claim entirely.

Three New Jersey rules unique to malpractice claims

These sit on top of the ordinary injury rules and they have no equivalent in a car or premises case.

N.J.S.A. 2A:53A-27

The affidavit of merit requirement

Within 60 days of the defense answer, the plaintiff must serve an affidavit from an appropriate licensed person stating there is a reasonable probability that the care fell outside acceptable professional standards. The court may grant one 60 day extension for good cause. Failure generally means dismissal with prejudice.

N.J.S.A. 2A:53A-41

The expert must match the specialty

Under New Jersey's patient safety legislation, the person giving the affidavit and the trial testimony must be credentialed in the same specialty as the defendant, with equivalent board certification where the defendant is certified. This narrows the pool of acceptable reviewers considerably and it drives the cost of the case.

N.J.S.A. 2A:14-2(b)

Birth injury claims run to the 13th birthday

Where an injury at birth is alleged, New Jersey sets its own deadline rather than applying the ordinary minority rules, and the claim must be brought before the child's 13th birthday. Families who assume they have until adulthood have lost claims to this provision.

The records that decide a malpractice claim

Facilities send a summary. A reviewer needs all of this, and you have a legal right to request it yourself.

01

The complete chart, not the summary

Request the entire record for the admission or the treatment period, in writing, and say complete record. A discharge summary is an author's account of events, not the evidence.

02

Nursing notes and flow sheets

Physicians write conclusions. Nurses record observations hour by hour, and the gap between what was observed and what was acted on is usually where the departure lives.

03

Imaging on disc, not the report

The report is one radiologist's reading. An independent reviewer needs the actual study to form an opinion, and reports are frequently where a missed finding gets buried.

04

The medication administration record

Shows what was actually given, when, by whom, and at what dose, which is often different from what was ordered in the chart.

05

The electronic audit trail

Every access to the electronic record is logged. In failure to follow up cases, this is what establishes that a result was viewed and that nobody acted on it.

Before receiving help, I was afraid because my health wasn't improving, and I didn't know what to do. The insurance company made things difficult, asking me questions I didn't know how to answer, and I felt lost and overwhelmed. Then I found this team, and from the very first conversation they gave me confidence and explained everything clearly. They guided me through the entire treatment process, helped me access the medical care I needed, and supported me every step of the way."

Where to request what a reviewer will need

You can start this yourself today, and it costs you nothing but a written request.

The treating facility's medical records department

Hackensack is the location of Bergen County's largest hospital along with numerous specialty practices and surgical centers. Each has a records department, and each responds to a written request from the patient or an authorized representative.

Your right of access under federal law

HIPAA gives you a right to your own records, generally within 30 days of a written request, and limits what a facility may charge. You do not need a lawyer or a lawsuit to exercise it.

New Jersey Motor Vehicle Commission

Holds crash records and provides the driver self report form used when no officer investigated the collision.

New Jersey Department of Health

Publishes hospital and long term care facility inspection and performance reporting, which can provide context on a facility's history.
