Most freight moves through an intermediary. A shipper hires a broker, the broker selects a motor carrier, and the carrier supplies the truck and the driver. Until recently, whether that broker could be sued depended entirely on where the crash happened.
Federal law broadly preempts state laws related to the price, route or service of a motor carrier or broker, and preserves a state's safety regulatory authority with respect to motor vehicles. Federal appeals courts agreed that a negligent selection claim against a broker falls within the preemption clause, and split sharply on whether the safety exception rescued it. Two circuits said it did and two said it did not, which meant a broker's exposure depended on the geography of the collision rather than on anything it had done. The Supreme Court resolved that in 2026 in a case arising from a highway crash. Writing for a unanimous Court, Justice Barrett held that state law negligent hiring claims against freight brokers are not preempted, because requiring a broker to exercise reasonable care in selecting a motor carrier concerns motor vehicles and therefore falls within the safety exception. Purely economic regulation unrelated to safety remains preempted. The facts of that case are the template. The carrier held a conditional safety rating from the federal regulator, deficient on driver qualification, hours of service, inspection, repair and maintenance, and its recordable crash rate. What to establish: the routing instructions, which sit with whoever dispatched the load rather than only with the driver.
In each of these the load paperwork names parties who never touched the truck and may nonetheless answer for it.

Negligent hiring claims survive
A unanimous Supreme Court held that state law negligent hiring claims against freight brokers are not preempted, because they fall within the federal safety exception.
Selection concerns motor vehicles
Requiring a broker to exercise reasonable care in selecting a motor carrier concerns motor vehicles, which is what the safety exception preserves.
Economic regulation stays preempted
The Court emphasised that state laws unrelated to motor vehicle safety remain preempted. This is not a general opening of brokers to state regulation.
Geography no longer decides
Before the decision, whether such a claim survived depended on which circuit the case was in. That divergence is resolved.

Two things a broker case is built on
The decision opened the route. It did not make these claims automatic.
What the broker could have found out
The federal regulator publishes carrier safety records, ratings and roadside inspection history, searchable by the identification numbers a carrier operates under. In the case the Supreme Court decided, the carrier held a conditional safety rating reflecting deficiencies in driver qualification, hours of service, inspection and maintenance, and its crash rate. That information was available to the broker before it tendered the load, which is precisely what makes the claim a failure to exercise reasonable care rather than hindsight.
What the broker actually did
The claim concerns the selection process itself, so the broker's own records are the evidence. What vetting it performed, what it required of carriers, whether it checked ratings and insurance, and whether it had procedures at all. Companies with documented standards for evaluating and monitoring carriers are in a different position from those that tendered a load to whoever accepted it. Those records are produced under demand rather than volunteered.

Preemption and the safety exception
Federal law preempts state provisions related to the price, route or service of a motor carrier, broker or freight forwarder with respect to the transportation of property, while providing that it shall not restrict the safety regulatory authority of a State with respect to motor vehicles.
