What the law actually requires, and what it does not

This is the argument insurers reach for first, and it is narrower than it sounds.

The burden, and the presumption

New Jersey places on the claimant the burden of establishing that death was not instantaneous, while affording a presumption of continuing life. Courts have acknowledged that this combination is an uneasy one. What matters practically is that the question is determined on evidence, and where a family has not conceded that they cannot prove an interval, it is generally a question for the trier of fact rather than something resolved on paper.

Consciousness matters only to some elements

Awareness is required for conscious pain and suffering. It is not required across the board. New Jersey's Appellate Division held that loss of enjoyment of life is a separate and distinct item of damages and that consciousness of the loss is not a prerequisite, and that holding underpins the model jury charge. The Survival Act carries the claim forward

The claim the person who died could have brought survives to their estate, covering the medical expenses, lost earnings and conscious pain and suffering between injury and death, and providing the route through which punitive damages may be pursued where conduct was sufficiently egregious.

Consciousness bears on compensatory damages

The New Jersey Supreme Court indicated that the question of consciousness is relevant to compensatory damages rather than to punitive ones.
