In a dense city the machine that gets you to work might be a motorcycle, a moped, a scooter or an electric bicycle, and from the roadside they can be difficult to tell apart. Legally they are not remotely the same.

New Jersey draws lines by power, speed and whether the machine has pedals. A motorcycle requires a licence endorsement, registration and insurance. A moped, which the state calls a motorized bicycle, is a pedal machine with a helper motor capable of no more than 25 miles per hour and under 50 cubic centimetres, and it must be registered, insured and ridden by a licensed operator. A pedal assist electric bicycle that stops assisting at 20 miles per hour sits in a different category again. And a machine under 50 cubic centimetres with no pedals at all cannot be registered as a moped, which pushes it toward motorcycle treatment. The rules changed materially in 2026. Legislation enacted that year brought electric bicycles into a registration and licensing framework, with a compliance deadline in July 2026 and a minimum rider age of fifteen. Under the Motor Vehicle Commission's guidance, registration applies across the categories while insurance is required for motorized bicycles rather than for low speed electric bicycles. Reporting on this has been inconsistent and some of it is simply wrong, so anything you read about it, including here, should be checked against the Commission's current guidance. For an injured rider this is not academic. Classification affects which insurance system you sit inside, whether any automatic medical benefit exists, and what a defence will say about compliance. Narrow streets parked both sides where a driver at a stop line sees a gap and takes it without registering an approaching rider.

What gets disputed: visibility, answered by measuring sight distance at the location rather than accepting what the driver says they could see.

Bus stops and stopped vehicles

Passing a stopped bus or delivery vehicle where neither the rider nor crossing pedestrians can see one another until the last moment.

What gets disputed: the rider's line and speed. Camera coverage along these corridors is the most reliable answer and it overwrites within days.

Whatever you were riding, the physical evidence disappears on the same schedule and the classification question should be answered in the first week.

Three ways classification changes what you recover

The distinctions look bureaucratic until somebody is injured, at which point they determine everything.

Which insurance system you sit inside

Motorcycles fall outside New Jersey's no fault medical benefits, so nothing automatically funds a rider's treatment and there is no injury threshold to clear either. How that framework applies to mopeds, motorized bicycles and electric bicycles is a different and more technical question, and it should be worked through against your specific machine and policies rather than assumed. It is the single most consequential thing to establish early.

Whose policy responds at all

Where a machine required insurance and carried it, that policy is the starting point. Where insurance was not required, or was required and absent, the search moves outward to household policies, to the at fault driver's coverage, and potentially to uninsured motorist protection. Establishing the category tells you which of those conversations you are having.

What the defence will say about compliance

Expect an argument that a rider was unregistered, unlicensed, uninsured or riding a machine in a category it did not belong to. Whether any of that actually affects the claim is a legal question rather than an obvious one, and it is not a reason to stay quiet about your circumstances. Be candid with a lawyer early so it can be assessed rather than discovered.

Moped Definition

What counts as a motorized bicycle

New Jersey defines a moped as a pedal bicycle with a helper motor capable of no more than 25 miles per hour on a flat surface, with a displacement under 50 cubic centimetres and no more than 1.5 brake horsepower. Registration, insurance and a licensed rider are required, and a comparable machine without pedals cannot be registered as one.

Motorcycles sit outside the no fault system

No automatic medical benefit applies to a motorcycle, and the limitation on lawsuit does not restrict riders either, so there is no injury threshold to clear. How this framework applies to other two wheeled categories is more technical and should be addressed on the specific facts.

Photograph the machine's label

Electric machines carry a permanent label showing classification, top speed and motor wattage. It is the fastest route to establishing which category you were in.

Find the registration and insurance documents

Whatever exists. Their presence or absence shapes the coverage analysis, and their absence is not a reason to avoid getting advice.

Preserve the machine itself

Damage patterns establish speed, angle and whether you were upright at impact, exactly as with a motorcycle. Do not authorise disposal.

Keep the gear you were wearing

Helmet, jacket, gloves and shoes. They carry the impact record and they are a claimable loss in their own right.
