Pedestrian law is written for towns with pavements and marked crossings. Much of Morris County has neither, and people still have to walk to a bus stop, a neighbour's house or the end of their own road.

The governing provision says that on highways where no sidewalks or paths are provided, pedestrians shall, when practicable, walk only on the extreme left side of the roadway or its shoulder facing approaching traffic. Insurers quote the first half of that sentence and stop. The qualifier matters, because a shoulder that is overgrown, flooded, snow covered, obstructed or simply absent is not a place a person can practicably walk, and the statute does not require the impossible. The same provision deals with crossing. Where traffic is not controlled by an officer or a signal, a pedestrian crosses within a crosswalk or, where there is none and it is not otherwise prohibited, at right angles to the roadway. So crossing away from a crosswalk is not automatically unlawful on a road that has no crosswalk for a mile in either direction. What is prohibited is crossing a highway with roadways separated by a central barrier except where provision is made. None of this is how an adjuster will describe it. Carriageway meeting a drainage ditch, a wall or a drop, so a pedestrian is in the traffic lane by necessity rather than by choice.

What has to be proved: that walking on the extreme left was not practicable. Photographs and measurements of the shoulder at that point are what establish it.

Winter and snow banks

Ploughing pushes snow onto the verge and removes the only place a pedestrian could walk, for weeks at a time.

What has to be proved: what the road looked like that week. Weather records and any photographs establish that the alternative did not exist.

Unlit roads at dawn and dusk

Where the clothing argument is made reflexively and lighting conditions at that hour are treated as though they were unknowable.

What has to be proved: what a reasonably attentive driver with headlights on should have seen, which is measurable rather than a matter of opinion.

In each of these the roadside condition is the evidence, and it changes with the season. Photographs taken in the first days are frequently the only record that survives.

What makes walking on the shoulder impracticable

The statute does not require the impossible, and establishing that is a question of evidence rather than argument.

There was no shoulder to walk on

A great many roads in this county have a carriageway meeting a ditch, a rock face, a guard rail or a drop. Where the physical alternative to the traffic lane does not exist, a pedestrian walking in the lane was not disregarding the statute, they were doing the only thing available. Photographs with something for scale, and measurements of the paved width, establish this in a way no description does.

It existed but could not be used

Overgrowth, standing water, ice, snow banks pushed up by ploughing, parked vehicles, bins on collection day, or road works. All of these are temporary, all of them are real, and all of them will be gone by the time anyone inspects. The condition on the day is what matters, and only contemporaneous photographs and weather records preserve it.

The alternative was more dangerous

Crossing to the other side to walk facing traffic sometimes requires crossing a road with no crossing point, poor sight lines and traffic at speed. Where the statutory course would itself have exposed a person to greater risk, that bears directly on what was practicable, and it is a point insurers do not raise for you.

Three rules for roads without pavements

Two govern the pedestrian. One governs the driver, and it is the one insurers mention least.

N.J.S.A. 39:4-34

Facing traffic, when practicable

On highways with no sidewalks or paths, pedestrians shall, when practicable, walk only on the extreme left side of the roadway or its shoulder facing approaching traffic. Crossing where traffic is uncontrolled is within a crosswalk or, absent one and where not prohibited, at right angles. Crossing a highway divided by a central barrier is unlawful except where provision is made.

A share of fault is not a bar

Where a pedestrian bears some responsibility, New Jersey reduces the recovery by that percentage and bars it entirely only where the pedestrian's share exceeds that of the parties they are claiming against. Most roadside cases are apportionment arguments rather than lost claims.

The duty does not disappear on a rural road

A driver's obligation to keep a proper lookout and to drive at a speed appropriate to conditions applies fully on unlit roads with poor sight lines. Where a stretch is predictably used by people on foot, what a driver should have been anticipating is part of the analysis.

Both sides of the road, with something for scale, showing width, surface, vegetation and any obstruction. Verges are cut and snow melts.

A pin, a nearby address or a utility pole number. Sight distance and shoulder width are measured at a specific point, not a general stretch.

Note the weather and the light

Time of day, conditions and what had happened in the preceding days. Weather records are obtainable and they corroborate what the photographs show.

Keep the clothing

It answers the visibility argument, and reflective elements on ordinary clothing are frequently more significant than people assume.

Township, county or state. Where shoulder condition or vegetation contributed, a public entity claim may exist with a notice period measured in weeks.
