The part of a settlement nobody explains until the end
.avif)
Families hear a figure and assume it is theirs. In a catastrophic case where Medicare has been paying for treatment, a portion of it is not, and the process of working out how much takes months.
Federal law provides that Medicare does not pay for treatment to the extent payment has been made, or may reasonably be expected to be made, by a liability or no fault insurer. Where an injury claim is outstanding, Medicare frequently pays anyway so that treatment continues, and those are called conditional payments. They are conditional on being reimbursed once a settlement arrives. This is not a soft obligation. Medicare has a direct right of action to recover from any entity that received payment from a primary plan, including the injured person, the attorney and the insurer. Ignoring it is not an option, and getting it wrong exposes the client rather than only the firm. There is a related trap that catches even experienced practitioners. Medicare Advantage and prescription drug plans assert their own recovery rights, and identifying every plan someone was enrolled in over recent years is a separate exercise from dealing with traditional Medicare. Missing one produces a demand after the money has been distributed. James Vasquez has handled New Jersey injury claims since 2004.
Catastrophic injuries we handle in Morris County
Where treatment has been extensive, the reimbursement question is proportionately larger.

Past, present and future
Compliance is usually described in three parts, and each has to be dealt with before a settlement can properly close.
Disputing unrelated charges
Conditional payment letters routinely include treatment that has nothing to do with the injury, because the process captures charges broadly.
What has to happen: a line by line review with the medical records. Removing unrelated charges directly increases what reaches the client.
Medicare Advantage and drug plans
Private plans administering Medicare benefits assert their own recovery rights separately from traditional Medicare.
What has to happen: identifying every plan the person was enrolled in over recent years. Missing one produces a demand after funds have been distributed.
Getting a final number
A final demand figure, obtained and resolved, so that funds can be distributed without exposure to a later claim.
What has to happen: this is the step that takes months, and it is why a settled case does not immediately become money in a client's account.
Past conditional payments
Treatment Medicare funded that related to the injury, recovered by the Benefits Coordination and Recovery Center once a settlement, judgment or award is made.
What has to happen: obtaining the conditional payment letter, reviewing every charge for relatedness, and disputing anything that belongs to an unrelated condition.
Reporting the settlement
A settlement, judgment or award should be reported so that any further related charges paid since the last letter can be identified.
What has to happen: prompt reporting, because charges continue accruing while a case runs and a stale figure is not a final one.
Future treatment
Protecting Medicare's interest in treatment still to come. In workers compensation there is a formal review process with published thresholds.
What has to happen: in liability cases there is no equivalent formal review process, because proposed regulations were withdrawn. The obligation is real and the mechanism is not prescribed.
None of this is optional and all of it is manageable. What it is not is quick, and families are better served knowing that at the outset.
Six things about Medicare and your settlement
Confirm current thresholds and figures, because several are recalculated annually.
Procurement costs come off
Recovery is capped at the settlement amount less the costs of obtaining it, so the fee and case costs reduce what Medicare can claim.
Very small settlements may be excepted
A low value threshold has applied below which recovery may not be pursued in liability and no fault cases. It is recalculated periodically and should be checked rather than assumed.
Charges can be disputed
Conditional payment letters routinely capture unrelated treatment. A line by line review against the records removes those charges and increases the net recovery.
Future care in liability cases
There is a formal review process with published thresholds in workers compensation. In liability cases proposed regulations were withdrawn, so the obligation exists without a prescribed mechanism.
Ask any lawyer how they handle Medicare reimbursement before you retain them, and ask specifically about Medicare Advantage plans. The answer tells you a great deal about what will actually reach you. For how these claims work statewide, see the catastrophic injury practice area page.
What happens between agreeing a figure and receiving money
This is the least explained phase of a catastrophic case and the source of most client frustration.

Obtaining the figure
A conditional payment letter has to be requested and reviewed, and the amount is recalculated as further related charges are identified. Because treatment frequently continues while a case runs, an early figure is never the final one. A settlement reported promptly allows the position to be brought up to date, and a final demand obtained, which is the document that permits distribution safely.
Disputing what does not belong
These letters capture charges broadly and routinely include treatment unrelated to the injury. Every line is checked against the medical records, and unrelated items are disputed with supporting documentation. This is unglamorous work with a direct effect on the client's net position, and it is where a competent handling shows most clearly.
Finding every plan
Traditional Medicare is only part of it. Medicare Advantage plans and prescription drug plans assert their own recovery rights, and federal legislation now requires information about a beneficiary's plan enrolments over recent years to be made available on request. Identifying all of them before disbursement prevents a demand arriving after the money has gone.
Three rules about Medicare and settlements
Federal rather than New Jersey law, and applicable wherever the claim is brought.
Medicare is a secondary payer
Medicare does not pay for items or services to the extent payment has been made, or may reasonably be expected to be made, through a liability, no fault or workers compensation source. Where it pays conditionally, it is entitled to reimbursement, and it has a direct right of action against any entity that received payment including the beneficiary and the attorney.
Recovery is reduced by the cost of obtaining it
The amount recoverable is limited to the settlement figure less the procurement costs, meaning attorney fees and case expenses reduce what Medicare can claim even where its payments exceeded the settlement. That reduction is applied by formula rather than negotiated.
Private plans recover too
Plans administering Medicare benefits assert recovery rights separately from traditional Medicare, and federal legislation requires information about a beneficiary's enrolments over recent years to be made available on request. Identifying every plan before distribution is essential rather than optional.
Lifetime cost projection, guardianship where capacity is affected, court approval of settlements and how fault is allocated among defendants are covered on the catastrophic injury practice area page and the Denville personal injury page.
What helps the reimbursement side
Most of it is information only you have.
List every plan you have been enrolled in
Traditional Medicare, any Medicare Advantage plan, and any prescription drug plan, going back several years. This single list prevents the most common and most expensive oversight.
Keep every explanation of benefits
They establish what was paid and by whom, which is the starting point for checking a conditional payment letter against reality.
Tell us about unrelated treatment
Conditions you were being treated for before the injury, or since, that have nothing to do with it. That is precisely what gets disputed off the demand.
Report changes in coverage
If you switch plans during the case, say so. Enrolment changes mid claim are a frequent source of missed recovery interests.
Expect the closing phase to take months
Not a sign of a problem. Obtaining and resolving a final figure is a process with its own timetable, and rushing it exposes you rather than protecting you.
