The layout supplies the hierarchy
Although the traffic code does not apply with the same force on private property, the way a lot is laid out establishes expectations that stand in for it. Thoroughfares carrying traffic through a lot are treated much as roads are, and feeder lanes serving rows of spaces are expected to yield to them. A vehicle emerging from a row into a through lane is in a position analogous to a side street entering a main road, and a driver reversing from a space owes a duty to look before moving. Where two vehicles reverse into one another, neither had priority and responsibility is frequently shared.
The property owner may share it
The owner of a car park has a duty to design and maintain a reasonably safe one. That extends to marked lanes and directional arrows, traffic controls where they are needed, adequate lighting, sight lines and surface condition. Where a collision happened because the layout was confusing, the markings had worn away or the lighting had failed, the owner or management company can be a defendant alongside the other driver. Ownership is frequently split between an adjacent business, a management company and sometimes a separate parking operator.
