No wages, and therefore, people assume, no loss. In fact the services provided by someone running a household and raising children are exactly the category New Jersey values at replacement cost. Childcare, transport, household management and care of relatives are all things a family now has to buy or go without, and an economist can establish what that costs across the years those services would have continued.
The retired grandparent
Frequently dismissed because they had left the workforce, which misses what they were actually contributing. Regular childcare, help maintaining a household, and the guidance and care they would have provided are compensable. The child
The most painful and the one the law addressed most directly. New Jersey rejected the idea that a child's life has no measurable value to their family, holding that parents may recover the pecuniary value of the companionship, care, advice and guidance that child would have provided as the parents aged. It applies regardless of the child's age.
Three rules that decide what a death claim is worth
Each addresses a question families ask and are rarely given a straight answer to.
Companionship and guidance have pecuniary value
The New Jersey Supreme Court held that wrongful death damages are not limited to lost financial contributions, and include the value of companionship, care, advice and guidance the person would have provided. It is confined to market value, comparable to what paid companions and homemakers cost, and expressly excludes emotional loss.
Pecuniary injuries, plus funeral costs
The statute directs damages measured as the pecuniary injuries suffered by the survivors together with hospital, medical and funeral expenses. Read alongside the case law above, that phrase reaches considerably further than lost wages, which is what most families assume it means.
Life insurance does not reduce the claim
New Jersey requires certain collateral benefits to be deducted from a recovery, but life insurance proceeds are treated differently from those sources. Families frequently assume a policy payout cancels out a claim. Confirm the current position, because the assumption is usually wrong.
