Three things people get wrong about claiming against a friend

This is the conversation that decides whether an injured passenger is compensated, and it is almost never had properly.

The rider generally does not pay personally

Liability insurance exists so that a person who causes harm does not have to fund the consequences themselves. A claim is presented to the insurer, the insurer investigates and defends, and any settlement comes from the policy. Where the coverage is adequate, the rider's own finances are usually not reached at all. That is what they were paying for.

Household exclusions are the real risk

Some policies exclude family members or people living in the same household from liability coverage. Where the rider is a spouse, partner or resident relative, that provision may mean the policy does not respond to your injuries at all. Declining to claim does not protect them

Where more than one party is responsible, New Jersey's allocation rules can permit a plaintiff to recover the full amount from a defendant bearing a substantial share of the fault, leaving the defendants to sort the balance among themselves. Household Exclusions

Family member coverage is not guaranteed

Some auto and motorcycle policies exclude household or family members from liability coverage. Where the rider is a spouse, partner or resident relative, the policy may not respond to a passenger's injuries. It is invisible without reading the policy and it should be checked before any decision is made.

No automatic medical benefits for anyone on a motorcycle

Because motorcycles sit outside New Jersey's no fault framework, neither the rider nor the passenger has automatic medical coverage from an auto policy. The limitation on lawsuit does not apply either, so there is no injury threshold to clear.

With no automatic medical coverage on a motorcycle, gaps appear easily and get used later. Arrange funding early rather than stopping when the bills arrive.

Do not discuss fault with anyone

Not with insurers, and ideally not in detail with the rider either. What you each remember will be recorded, and casual reassurance now becomes a problem later.

Have the conversation early

If the rider is someone close to you, raise it directly. In most cases their insurer handles it and nothing between you changes. Discovering otherwise late is worse for everyone.
