The result nobody acted on
An abnormal blood test, imaging finding or biopsy returns to a practice, is filed to the chart, and nobody contacts the patient. Months later the same condition presents far advanced. The prudent patient standard
New Jersey rejected the professional standard for informed consent and adopted a patient centred test. A physician must disclose what a reasonably prudent patient in that position would find material to deciding whether to proceed, and causation is assessed by whether such a patient would have chosen differently.
The affidavit of merit
Within 60 days of the defence answer, an affidavit from an appropriately credentialed professional must state there is a reasonable probability the care fell outside acceptable professional standards. One extension may be granted for good cause, and failure generally means dismissal with prejudice.
When the clock starts on a late diagnosis
The ordinary period is two years, and New Jersey recognises in limited circumstances that it may begin when a person reasonably should have discovered both the injury and that it was attributable to someone's fault.
