Before 2005 several states held vehicle owners automatically responsible for crashes caused by anyone driving with permission, which put rental fleets on the hook for every customer's mistake. Congress ended that.

The Graves Amendment provides that an owner of a motor vehicle that rents or leases it out shall not be liable under the law of any state, by reason of being the owner, for harm arising out of the use, operation or possession of the vehicle during the rental or lease period. Two conditions apply. The owner must be engaged in the trade or business of renting or leasing motor vehicles, and there must be no negligence or criminal wrongdoing on the part of the owner. That is a bar on vicarious liability specifically, meaning responsibility arising purely from ownership. It is not immunity. The second condition is the opening, and it covers the company's own conduct rather than the driver's. Courts have applied it cautiously given the clear congressional intent behind the provision, so it is not a route to be assumed. One limit worth knowing. The protection applies to businesses in the trade of renting or leasing. The owner's own negligence

Failure to maintain a vehicle the owner had agreed to maintain, or similar active negligence, falls outside the protection because it is not vicarious.

Negligent entrustment

Renting to somebody plainly unfit to have the vehicle, for instance without a valid licence, is the company's own conduct rather than the driver's.

The protection covers companies engaged in renting or leasing. A private individual who lends a car is outside it entirely.

Where The Recovery Comes From

Two things that matter more than the company's name

In most rental collisions the claim proceeds normally against different parties.

The driver and whatever stands behind them

The federal bar does not touch the claim against the person who caused the collision. What varies is the coverage behind them. A renter may have their own auto policy extending to a rental, may have purchased supplemental liability protection at the counter, or may have coverage through the credit card used to book. Establishing which of those exist, and their limits, is the practical work in a rental collision and it is frequently more productive than arguing about the company.

Whether verification technology was used

One area that has developed since the provision was enacted. In the early 2000s rental companies had limited ability to check a customer's driving record beyond looking at a licence. Verification systems are now widely available, and some courts have considered whether failing to use them can amount to negligence by the company. It is not a settled route and it is a genuine line of enquiry where a driver plainly should not have been given a vehicle.
