New Jersey requires a motorcycle licence or endorsement to ride, obtained by road test or by completing an approved safety education course. The argument gets made in almost every case. Whether it goes anywhere depends on these.

Did it have anything to do with the collision

A licensing violation raised as comparative fault has to be connected to how the crash actually happened. Where a driver turned left across an oncoming motorcycle, or pulled out from a side street into its path, it is difficult to explain what an endorsement would have changed. Where the allegation is that inexperience produced a loss of control on a bend, the connection is more available. That distinction is the whole of it, and it should be assessed on the facts rather than conceded.

What does it do even if it lands

New Jersey apportions fault by percentage and reduces a recovery accordingly, barring it only where the injured person's share exceeds that of the parties they are claiming against.
