Canvass cameras within days

Protect the fund route

Do not wait for the investigation

It exists for people who would otherwise have no remedy at all, and it operates on strict conditions that are easy to fall foul of.
What it covers
New Jersey maintains a fund providing a measure of relief to people injured by uninsured or unidentified drivers who would otherwise be without a remedy. Since 2004 its role has included providing medical benefits to pedestrians struck by a private passenger vehicle where no other coverage is available. It is administered by a statutory association rather than by an insurer, and it is a route of last resort rather than a first port of call.
The 180 day notice
A notice of intention to make a claim must generally be given within 180 days of the accident, and it functions as a condition precedent to the right to apply for payment afterwards. There are narrow provisions addressing claimants who were physically incapable of giving notice in time. Nobody should rely on those. The practical rule is that the notice goes in early, before anyone knows whether it will be needed.
Who it excludes
The fund is not available where the injury is covered by workers compensation, and it excludes claims by a spouse, parent or child of the person responsible. It also requires you to have investigated and exhausted other available insurance first, including policies held by household members. Establishing what exists elsewhere is therefore part of the work rather than a preliminary to it.

180 days to notify the fund

Leaving the scene is an offence
New Jersey requires a driver involved in a collision resulting in injury to stop, remain at the scene and provide information. Where a driver is identified and prosecuted, that record is useful in a civil claim, though the criminal case is separate and does not compensate you.
Your household policy may respond
Uninsured motorist coverage on a policy held by you or a resident relative can respond where a driver is unidentified or uninsured, even though you were on foot. Even a partial description or a direction of travel. The report is a condition of coverage routes as well as the start of any investigation.
Keep your clothing exactly as it is
Paint transfer and fragments embedded in fabric can identify a vehicle. Do not wash anything, and bag it if you can.
Photograph the scene and any debris
Lens fragments, trim and glass on the roadway. These are swept or scattered within hours and they frequently identify a make and model.
Ask nearby businesses to hold footage
In writing, naming the date and time window. Verbal requests are forgotten and the recording cycle keeps running.
Find every policy in your household
Yours and any resident relative's. Uninsured motorist coverage may respond, and the fund route requires establishing that other coverage does not exist.
