The vehicle must have been in use here

Courts have required a substantial connection between the use or operation of the insured out of state vehicle and the accident. A parked vehicle has been held not to satisfy that.

The usual trade off does not bite

For a car driver the deemer statute brings benefits along with the verbal threshold. Riders are not subject to that threshold, so the trade off that concerns drivers does not apply in the same way.

Coverage Behind The Other Driver

Two things worth establishing immediately

Both shape the case more than anything about how the collision happened.

The minimum has been rising

New Jersey's minimum bodily injury coverage has increased in stages, from fifteen thousand dollars per person for policies issued or renewed before 2023, to twenty five thousand for those issued or renewed from January 2023, and to thirty five thousand for those issued or renewed from January 2026. The controlling date is the policy's issue or renewal date rather than the date of the crash, so two drivers in the same collision can carry different minimums. It is worth checking rather than assuming the old figure.

Where the policy was written changes things

Under the deemer statute an out of state policy issued by a carrier authorised here is treated as guaranteeing New Jersey's minimum bodily injury limits, and the Supreme Court confirmed in 2020 that the creation of the basic policy option did not change that. Where the carrier is not authorised here, the statute does not apply, and the claim proceeds against the out of state policy on its own terms with your own uninsured or underinsured coverage behind it.

The Appellate Division has held that the statute applies only where there is a substantial connection between the use or operation of the insured out of state vehicle and the accident. A vehicle that was parked and not in use did not satisfy that requirement.

Why riders have no benefits to begin with
