Something other than weather contributed

The immunity covers injury caused solely by the effect of weather on the use of streets and highways. A decision about closure is not weather.

The closure was inadequate

Expert evidence in New Jersey litigation has been that traffic cones do not meet recognised standards for an effective traffic control device and are ineffective as a barrier.

It was closed at one end only

In that same case barricades blocked the underpass from one direction and not the other, so a driver approaching from the open side had no warning at all.

The location floods every time

A failure to warn claim requires actual notice, and courts enforce that strictly. A location that floods whenever it rains, acknowledged by the entity's own staff, is how that is established.

Both are answerable in a week and both can end a claim if left.

Roads here are maintained by three different levels

State highways are overseen by the transportation department, county roads by the county, and township streets by the municipality, and the boundary is not visible from the road. That determines who any notice of claim is served on, who holds the drainage and maintenance records, and who made the decision about closing. Serving the wrong entity is a common and avoidable problem, and it is resolved by asking rather than assuming.

Ninety days, not two years

Where a public entity may be involved, a notice of claim is generally required within 90 days of the incident as a condition of bringing suit, and a further waiting period follows before a complaint can be filed. Courts have accepted notices that were technically deficient but substantially satisfied the purpose. They have not been forgiving about notices that were never served. Treat the 90 days as the operative deadline until somebody establishes otherwise.

Where anything other than weather contributed, including how a road was closed or whether it was closed, the injury was not caused solely by weather.

Failure to warn requires actual notice

A claim that a public entity failed to warn of a dangerous condition requires actual notice, and the Appellate Division has upheld that requirement. A location known to flood whenever it rains, acknowledged as such by the entity's own staff, is how notice is established.

Ninety days to give notice

A claim against a public entity generally requires a written notice of claim within 90 days of the incident. Courts have accepted notices in substantial compliance where technically deficient, but the requirement itself is strict and a missed deadline cannot be recovered.

Photograph both approaches
