Your own insurer, on the other side

Uninsured and underinsured motorist coverage is the part of a policy nobody thinks about until it is the only thing left. It is also the part that behaves least like people expect.
This is first party coverage, meaning a claim under your own contract rather than against a wrongdoer. That changes the relationship immediately. Your carrier is no longer processing a claim on your behalf, it is defending a claim made against it, and it assesses your injuries and your credibility the way a defence lawyer would. That shift catches people badly, because nothing about the relationship up to that point suggested it was coming. It also means the policy governs almost everything. Rights differ substantially between carriers, and the procedure for pursuing a claim comes from the contract rather than from a statute. Most New Jersey policies send these disputes to arbitration, though some newer policies allow the carrier to elect court instead. Reading the actual policy language before doing anything is not a formality here. James Vasquez has handled New Jersey injury claims since 2004, and the office is a short drive from Hawthorne.
Hawthorne car accident claims we take on
Coverage questions run through most of these.

Where Hawthorne crashes happen
A borough with highway access on one side and residential streets on the other.
Goffle Road and Lafayette Avenue
Arterials carrying volume between Paterson, Fair Lawn and the northern boroughs, with turning conflicts throughout.
Why coverage matters: commuter corridors carry drivers from everywhere, and establishing what insurance the other driver actually had is the first step.
The Paterson and Fair Lawn borders
Streets crossing municipal lines, so the responding department may not be the one you would expect.
Why coverage matters: it affects where the crash report is held, and that report is what establishes the other driver's insurance.
Route 208
Merging and exiting traffic at sustained speed, where injuries are severe enough that policy limits decide the outcome.
Why coverage matters: serious injuries routinely exceed minimum liability limits, which is precisely when your own underinsured coverage becomes the larger claim.
The residential grid
Sight lines of a few metres with vehicles pulling out between parked cars at low speed.
Why coverage matters: low speed does not mean low injury, and a minimum limits policy is quickly exhausted by an orthopaedic injury.
Wherever it happened, establishing what coverage exists on both sides is the step that shapes everything after it.
Four things that change
None of this is improper. It is how first party coverage works, and almost nobody is told in advance.
The relationship reverses
Your carrier evaluates the claim as the opposing party. Recorded statements, examinations and scrutiny of your treatment all follow.
The policy sets the rules
Procedure, notice requirements and how disputes are resolved come from your contract, and they differ substantially between carriers.
Arbitration is common
Most New Jersey policies send these disputes to arbitration, frequently with three arbitrators and frequently non binding, so a dissent can open a jury trial.
Underinsured comes second
An underinsured claim generally requires the at fault driver's coverage to be resolved first, which makes the order of steps decisive.
If the other driver was uninsured or carried minimum limits, get your own declarations page in front of someone before you agree anything. For how car accident claims work statewide, see the car accident practice area page.
The notice step that protects an underinsured claim
This is the most commonly mishandled part, and New Jersey's position is more nuanced than the usual advice suggests.

Notify your own carrier in writing first
Where you intend to accept a settlement from the at fault driver, New Jersey practice requires notifying your underinsured carrier before doing so. The carrier can consent, which waives its right to pursue the other driver, or preserve that right by paying you the equivalent of the other driver's limits itself in exchange for taking over the claim against them. Where a carrier does not respond within a defined period, there is a route to court for a determination.
The consent point is frequently overstated
You will read that settling without your carrier's consent forfeits underinsured coverage outright. New Jersey courts have held that strict consent to settle clauses are contrary to public policy, so the position is better described as a notice procedure than an absolute veto. That said, failing to follow it properly can still jeopardise the claim, and it is not a step to improvise around.
Three rules about your own coverage
Confirm against your actual policy, because these claims are governed primarily by contract.
The claim is against your own insurer
Uninsured and underinsured motorist coverage provides compensation under your own policy for losses caused by a driver with no insurance or insufficient insurance. Entitlement and procedure are governed primarily by the contract, and rights differ substantially between carriers, so the policy language has to be read before a claim is pursued.
Most policies arbitrate, some do not
Most New Jersey uninsured and underinsured policies resolve disputes by arbitration, commonly using a three arbitrator panel and frequently on a non binding basis so that a dissent preserves a right to trial. Some newer policies permit the carrier to elect court instead. Which applies is a policy question rather than a general rule.
Tell your carrier before accepting
Where an underinsured claim may follow, New Jersey practice requires notifying your own carrier of a proposed settlement with the at fault driver. The carrier may consent or preserve its position by substituting payment. Consent to settle clauses have been held contrary to public policy, so this operates as a notice procedure rather than an absolute veto.
Personal Injury Protection, the verbal threshold, the two year filing deadline and comparative negligence are covered on the car accident practice area page and the Hawthorne personal injury page.
What to do first
Short list, and the order matters.
Get your declarations page
It establishes what uninsured and underinsured coverage you actually carry, which most people have never checked.
Report promptly, including hit and run
Prompt police reporting is a condition of uninsured coverage responding in a hit and run. Delay can defeat the claim outright.
Establish the other driver's limits
The crash report records the insurance presented. Whether their limits are minimum or substantial determines whether your own coverage is engaged at all.
Do not settle before notifying your carrier
Where an underinsured claim may follow, written notice to your own insurer comes before accepting anything from the other side.

"Mr. Vasquez was able to recover a good settlement for me and he recommended me to great medical professionals to help with my back and neck injuries."

James Vasquez was the first name everyone recommended. People told me he would make sure I was taken care of, and they were right. The team was friendly, professional, down to earth, and experienced. They handled everything, and all I had to do was listen, follow their guidance, and focus on my recovery. One of the best parts of the experience was working with the paralegal, John Velazquez. Whenever I had questions, he would stop what he was doing, sit down with me, and explain everything in detail. I never felt rushed, and I always felt that my concerns were fully answered. He helped me understand every step of the legal process, and I truly felt like I had a friend inside the firm."

After the accident at work, my health and my ability to work changed dramatically. I faced many challenges because I could no longer do the same things I used to do. Before receiving help, I was afraid because my health wasn't improving, and I didn't know what to do. The insurance company made things difficult, asking me questions I didn't know how to answer, and I felt lost and overwhelmed. Then I found this team, and from the very first conversation they gave me confidence and explained everything clearly. They guided me through the entire treatment process, helped me access the medical care I needed, and supported me every step of the way."

"James Vasquez and his team took care of my case like if it was their own. I was able to take care of my car accident case, and even during this pandemic. I never felt pressured, and they were definitely patient with my case."

Two documents do most of the work.
Establishes your uninsured and underinsured limits, your tort option, and the procedure your carrier requires for these claims.
Holds the crash report including the insurance presented at the scene, which is how the other driver's coverage is established.
Request your records periodically. In a first party claim your own carrier reads them with the same scrutiny an opposing insurer would.
