The first is evidentiary. Where a collision occurs between a vehicle and a pedestrian within a marked crosswalk, or at an unmarked crosswalk at an intersection, the law provides for a permissive inference that the driver failed to exercise due care for the pedestrian's safety. That does not decide a case, and it changes the starting position considerably from the one most people assume they are in. The second is about signals. A pedestrian crossing on a green or walk indication has right of way over all vehicles, including those making turns. Turning drivers looking for a gap in traffic rather than for a person already crossing are the most common cause of injury at signalised junctions, and the rule addresses precisely that. The third is newer. Since March 2022 New Jersey has required drivers to pass vulnerable road users with due caution, which means moving over a lane where one exists, allowing at least four feet on a single lane road, and where neither is possible slowing to twenty five miles per hour and being prepared to stop. Move over a lane

Where there is a lane to move into, and while following all existing rules about no passing zones and speed limits.

Four feet of space

On a single lane road, a driver must allow a safety zone of at least four feet when passing a vulnerable road user.

Slow to twenty five

Where four feet is not possible, the driver must reduce speed to twenty five miles per hour and be prepared to stop until they can pass safely.

More than cyclists

People walking, cycling, using a scooter or electric scooter, in a wheelchair, or on a skateboard are all within the protected group.

The person, not the line

Where someone is on a shoulder or in a painted bike lane, the four feet is measured from the person rather than from the painted marking.

Higher where injury results

A violation carries a fine, rising substantially with motor vehicle points where bodily injury is caused.

None of them decides a case. All of them change the starting position.

The permissive inference in a crosswalk

Where a collision occurs between a vehicle and a pedestrian within a marked crosswalk, or at an unmarked crosswalk at an intersection, New Jersey provides for a permissive inference that the driver did not exercise due care for the pedestrian's safety. It is permissive rather than conclusive, meaning a jury may draw it rather than must. This addresses the single most common serious collision at signalised junctions, where a driver turning on a green light watches for a gap in oncoming traffic and never registers the person already crossing in front of them.

The duty to stop, not merely yield

New Jersey requires a driver to stop and remain stopped for a pedestrian crossing within a marked crosswalk, which is a stronger obligation than yielding. A driver who slowed, judged there was room and passed behind you has not complied, and the penalty for failing to stop is substantial including community service and points.
