When A Child Was Struck

The standard is not the one applied to adults

This changes the analysis substantially, and it is the answer to the argument families hear first.

A child is judged as a child

New Jersey does not measure a young child's conduct against what a reasonable adult would have done. The standard is what is reasonable for a child of that age, intelligence and experience, and for very young children the capacity for negligence may not be recognised at all. That is why the darted out argument, which sounds decisive when an adult hears it, carries far less weight than drivers and insurers assume.

Drivers are expected to anticipate children

Where the surroundings put children plainly in the picture, such as a residential street, a school approach or a lot beside a playground, what constitutes reasonable care by a driver rises accordingly. Speed that would be unremarkable elsewhere is not, and the expectation of a child appearing suddenly is part of driving there rather than an unforeseeable event.

It is a specific duty, and it is frequently the whole case in a driveway incident.

On private property this list matters more than anywhere else, because nobody else is creating a record.

Demand the footage in writing

To the store, the complex or the property manager. Identify the date, time and location precisely. Verbal requests get forgotten and the cycle keeps running.

Report it to the business and ask for the report

Most complete an internal incident report even when police do not attend. Request a copy in writing, which at minimum establishes it exists.

Call the police anyway

They may decline to prepare a state crash report on private property, but a call creates a record with a time stamp that is useful later.

Photograph the layout
