You were following too closely
Raised where a second rider could not avoid the first. New Jersey does require drivers to leave reasonable distance, and the question is what distance was actually being kept and whether any rider could have stopped in it. Where the lead rider was struck without warning by a turning vehicle, the rider behind faced a hazard that appeared without notice, which is a very different situation from following too closely into predictable traffic.
You could have avoided it
Applied particularly to a rider who went down avoiding a collision without ever being touched. A claim still exists where the evasive action was a reasonable response to another driver's negligence. Riders remain outside the no fault system
