Two Questions, Two Claims

How the fall and the care are assessed separately

They arise from one event and they are proved from completely different material.

Why they fell

A premises claim against whoever was responsible for the condition that caused it. This turns on ordinary questions: what the hazard was, whether the owner knew or should have known about it, and whether reasonable steps were taken. It is proved from maintenance records, inspection logs, prior complaints, weather data and photographs taken before anything is repaired. It requires no medical expert to establish the negligence itself.

What happened afterwards

A medical claim, which is a substantially higher hurdle. It requires an expert in the relevant specialty to say the care fell below the accepted standard, and in an area where clinical practice is genuinely debated, that opinion may not be available. An honest assessment sometimes concludes that the treatment was within a range of reasonable approaches even though the outcome was catastrophic.

Why both are looked at together
